By scanning the QR code, entering your phone number, and opting into the Thrive Orthopedics automated messaging system, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not check the consent box or submit your phone number.

2. Medical Disclaimer (Not Medical Advice)
The SMS/RCS messages provided by Thrive Orthopedics contain general care, maintenance, and usage instructions for the Equinus Brace Treatment Protocol. These messages do not constitute professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or your specific treatment plan. In the event of a medical emergency, call 911 or your doctor immediately.

3. Thrive Orthopedics SMS Terms & Conditions
By opting in to our messaging program, you agree to the following terms regarding our text communications:

  • Program Description: Thrive Orthopedics offers an automated text messaging program providing care instructions, maintenance tips, and adherence support for the 90-day Equinus Brace Treatment Protocol.

  • Message Frequency: Message frequency varies based on the specific timeline of your 90-day protocol.

  • Pricing: Standard message and data rates may apply depending on your mobile carrier plan.

  • Opt-Out / Cancellation: You can cancel the SMS service at any time. Just text "STOP" to the number sending you messages. After you send the SMS message "STOP" to us, we will send you one final SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

  • Help / Support: If you are experiencing issues with the messaging program, you can get help directly by emailing sales@thriveorthopedics.com or calling (484) 442-0494.

  • Carrier Liability: Mobile carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

4. Privacy and Unencrypted Communication Acknowledgment
Our use of your personal and health information is governed by our Privacy Policy. Furthermore, by participating in this SMS program, you expressly acknowledge that standard text messaging (SMS/RCS) is not an encrypted communications channel. You understand and accept the risk that health-related information contained in these messages could be intercepted or accessed by third parties, and you explicitly consent to receiving your treatment protocol via this unencrypted channel.

5. Limitation of Liability
To the maximum extent permitted by law, Thrive Orthopedics and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of or inability to use the messaging service or your reliance on the instructions provided.

These Terms shall be governed by and construed in accordance with the laws of the State of IN, without regard to its conflict of law provisions.
